Terms & Conditions

Last updated: September 10, 2026

By confirming your order and checking the acceptance box, you agree to these Terms & Conditions and our Privacy Policy. We are a weekend criollo-food business in Cidra, Puerto Rico.

1. The service

We offer prepared food for pickup in Cidra during our weekend hours. Availability and hours may vary.

2. Orders and payments

Prices are in US dollars and include applicable IVU sales tax under Puerto Rico law. We accept ATH Móvil and cash.

When your payment is confirmed you receive an email receipt. The order is prepared for the stated pickup time; you are responsible for picking it up.

3. Availability

Items can sell out. If something is unavailable we will let you know or coordinate with you.

4. Cancellations and refunds

Because this is fresh food prepared to order, to cancel or change an order you must contact us as soon as possible at hola@elfogondelamontana.com before we begin preparing it. If you cancel in time, we refund the full payment by the same method (ATH Móvil) within a reasonable period. If the order is already being prepared or is ready, we may not be able to refund it. If we cancel or cannot complete your order (for example, an item sells out), we will refund the corresponding amount in full.

5. Allergens

We prepare food in a shared kitchen and allergen cross-contact is possible. If you have allergies, ask us before ordering.

6. AI tools (for staff)

The admin panel includes an AI assistant as a support tool for the owner and staff. AI suggestions must be reviewed and confirmed by a person; they are not professional advice. See the AI section of the Privacy Policy.

7. Intellectual property

The El Fogón de la Montaña brand, logo and content belong to us and may not be used without permission.

8. Limitation of liability

The service is provided "as is". To the extent permitted by law, we are not liable for indirect damages arising from use of the site or service.

Nothing in these terms limits or excludes our liability for damages that cannot be limited under Puerto Rico law, including liability for personal injury caused by our gross negligence or willful misconduct.

9. Governing law and venue

These terms are governed by the laws of the Commonwealth of Puerto Rico. Any dispute shall be submitted to the courts of Puerto Rico.

10. Accessibility

We aim to make this site usable for people with disabilities, using the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a reference. If you encounter an accessibility barrier, email us at hola@elfogondelamontana.com and we will make reasonable efforts to help you complete your order.

11. Changes and contact

We may update these terms; the date above shows the last revision. The Spanish version of these terms prevails for consumers in Puerto Rico.
